These Terms and Conditions ("Terms") govern your use of the Ark Quests website and the travel services provided by Ark Quests ("we", "our", "us"). By using our website or booking our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using this website, you accept and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

2. Services

Ark Quests provides curated travel experiences ("Quests") in the Maldives. Our services include itinerary design, accommodation booking, transfer arrangements, and activity coordination. All services are subject to availability and confirmation.

3. Booking Process

  • All bookings begin with an inquiry through our contact form, email, or WhatsApp.
  • Upon receiving your inquiry, we will prepare a personalised itinerary proposal.
  • A booking is confirmed only when we receive your signed confirmation and the required deposit payment.
  • Prices quoted are per person unless stated otherwise and are subject to change until a booking is confirmed.

4. Payment Terms

  • A deposit of 30% of the total trip cost is required to confirm your booking.
  • The remaining balance is due 30 days before your arrival date.
  • Payments can be made via bank transfer or other methods we specify at the time of booking.
  • All prices are quoted in US Dollars (USD) unless otherwise stated.

5. Cancellation Policy

  • 30+ days before departure: Full refund minus a $100 administration fee.
  • 15–29 days before departure: 50% refund of total trip cost.
  • 14 days or less before departure: No refund.
  • We strongly recommend purchasing comprehensive travel insurance to cover cancellations, delays, and medical emergencies.

6. Changes and Modifications

We will do our best to accommodate changes to your itinerary after booking. Changes are subject to availability and may incur additional charges. We reserve the right to make minor adjustments to itineraries due to weather, availability, or safety considerations.

7. Travel Documents

It is your responsibility to ensure you have valid travel documents (passport, visa, vaccination records) for your trip to the Maldives. Ark Quests is not liable for any issues arising from inadequate travel documentation.

8. Travel Insurance

We strongly recommend that all travelers obtain comprehensive travel insurance covering trip cancellation, medical expenses, evacuation, and personal belongings. Ark Quests is not liable for losses not covered by insurance.

9. Liability

Ark Quests acts as an intermediary between you and third-party service providers (hotels, boat operators, dive centres, etc.). While we carefully select our partners, we are not liable for:

  • Acts, omissions, or defaults of any third-party service provider
  • Loss, injury, or damage to persons or property arising from activities during your trip
  • Delays or changes caused by weather, natural disasters, political unrest, or other events beyond our control

Our total liability in any event shall not exceed the total amount paid by you for the specific trip in question.

10. Health and Safety

Certain activities included in our quests (diving, snorkeling, water sports) involve inherent risks. By participating, you acknowledge and accept these risks. You are responsible for disclosing any health conditions that may affect your ability to participate safely.

11. Intellectual Property

All content on this website — including text, images, logos, graphics, and design — is the property of Ark Quests and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

12. Privacy

Your use of our website is also governed by our Privacy Policy. Please review it for details on how we collect, use, and protect your personal information.

13. Dispute Resolution

Any disputes arising from or related to these Terms shall be governed by the laws of the Republic of Maldives. Both parties agree to attempt to resolve any dispute amicably before resorting to formal legal proceedings.

14. Force Majeure

Ark Quests shall not be held liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, strikes, war, or terrorism.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services constitutes acceptance of any changes.
